A personal injury case involving a truck accident requires additional consideration and special investigation. A truck accident attorney has knowledge with regards to the regulations at both the federal and CA state levels, which have additional rules. Among these additional rules include: adequate hours of rest and proper training for truck drivers, proper loading and different speeds for truck drivers and additional rules for the safe passing of other vehicles by trucks to avoid a truck accident. Trucks with a gross weight more than 10,000 pounds account for a disproportionately large share of traffic deaths based on miles traveled. The incidents of fatalities form large trucks have increased approximately 10 percent from 1995 through 1998. The rate for fatal crashes involving trucks is 2.6 deaths per 100 million vehicle miles traveled. This rate is an alarming 50 greater than the rate for all vehicles on the road with nearly 80 percent of them involving more than one vehicle. The U.S. Department of Transportation's Federal Motor Carrier Safety Administration implemented new rules in 2003 with a compliance date of January 4, 2004. The regulation allows truck drivers to drive 11 hours after 10 consecutive hours off-duty. Truck drivers may not drive beyond the 14th hour after coming on-duty, following 10 hours off-duty. Moreover, they may not drive after being on-duty for 60 hours in a seven-consecutive-day period or 70 hours in an eight-consecutive-day period this on-duty cycle may be restarted whenever a driver takes at lease 34 consecutive hours off-duty. Trucking companies are required to keep record of the hours of driving by truck drivers, and of the weight and loading of their trucks. Although the truck companies don't willingly offer up these records to an individual, an experienced attorney working on your case can demand these records in litigation.
