Procedure of an Arrest

In the event of a driver being punished for violation of the vehicle code, an officer may arrest the driver under section 40300. A police officer may arrest a driver without a warrant if the officer reasonably believes the person had been driving under the influence of alcohol or a drug in the any given situations. First, if the person is involved in an accident, obstruction of a road, the person may cause injury to himself or others, and the possibility of evidence being destroyed. In addition, if the driver is involved in a felony, they may also be arrested and taken into custody. However, in the event of arresting a minor, the driver is to be delivered to the custody of a probation officer. Here, the officer will keep the minor in juvenile hall pending his trial.
