A DUI conviction is subject to severe consequences. Your driver's license will be suspended for six months upon your first conviction. Your attorney can petition for a restricted license. A second DUI within seven years swill result in a two-year suspension. If a third DUI is received, driving privileges may be revoked for three years. Pursuant to Vehicle Code § 13202, a court has the authority to suspend or order the department to revoke the privileges of a driver involved in a DUI. The court is then to determine the time for suspension or the period of revocation to apply for a license, as long as it does not exceed three years. In accordance with California Vehicle Code §23536, if a person is convicted of driving under the influence, the person shall be punished in county jail for no less than 96 hours and no more than 6 months.
