Drivers License Privileges

A Drivers License is a privilege that may be awarded to drivers. However, the privilege may be revoked, suspended, or lost by an individual in certain instances. Pursuant to Vehicle Code §13100, a license may be revoked. Revocation means the person's privilege to drive a motor vehicle is terminated and a new driver's license may be obtained after the period of revocation.

In addition, a license may also be subject to suspension under Vehicle Code §13102. Suspension means that the person's privilege to drive a motor vehicle is temporarily withdrawn. The department may, before terminating any suspension based upon a physical or mental condition of the licensee require such examination of the licensee as deemed appropriate in relation to evidence of any condition which may affect the ability of the licensee to safely operate a motor vehicle. The laws regarding suspension are specific. If your driving privileges have been taken away you must wait the required time (this can be from a month to a year or more), comply with court or DMV requirements, pay any outstanding traffic or criminal fines, and pay a $126 reinstatement fee at the DMV.

The occurrence of revocation or suspension may arise for a number of reasons. Pursuant to Vehicle Code §13201, a court may suspend, for not more than six months, the privilege of any person to operate a motor vehicle upon conviction of any of the following offenses. First, if the driver in an accident fails to stop. Second, a violation may also occur when reckless driving proximately causing bodily injury to any person under Section 23104. Also, knowingly causing or participating in a vehicular collision, or any other vehicular accident, for the purpose of presenting or causing to be presented any false or fraudulent insurance claim may be subject to penalty.
