An attorney lien is a fee security agreement that provides counsel a way to satisfy attorney fees out of the funds recovered for the client. The lien may enforceable against the client in an independent action. The conditions of the lien must be fair and reasonable, fully explained, and consent in writing in order to be found effective. The lien is often incorporated into an employment agreement where the client may agree to pay 33% of the sums received which therefore gives the attorney a lien upon funds received for payment. The lien may also be in a separate agreement with the attorney. Priority of lien is given to the first lien created. In certain instances a client may decide to discharge an attorney. If the attorney has fully performed their agreement, the attorney is entitled to the complete amount in the contract. However, if the attorney has partially performed their obligation, the attorney is entitled to recovery for the work created.
